By accessing or using EQUOS9 ("the Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.
EQUOS9 provides cloud-based business management software for operations including order management, inventory tracking, warehouse management, and related business functions. The Service is provided on a subscription basis.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, database, or content. We may also impose limits on certain features or restrict access to parts or all of the Service without notice or liability.
To use certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and your business.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity without appropriate authorisation.
EQUOS9 offers a 14-day free trial for new users. During the trial period, you will have access to the features included in your selected plan. No payment is required during the trial period.
At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
Subscription fees are billed in advance on a monthly or annual basis depending on the billing cycle you select. Payment is due at the beginning of each billing period.
All fees are exclusive of applicable taxes, which will be added where required by law. You are responsible for paying all taxes associated with your use of the Service.
Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms. If you cancel your subscription, you will continue to have access to the Service until the end of your current billing period.

The Service and its original content, features, and functionality are and will remain the exclusive property of EQUOS9 and its licensors. The Service is protected by copyright, trademark, and other laws of Australia and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of EQUOS9.
You retain all rights to the data you upload or input into the Service ("Your Data"). By using the Service, you grant us a limited licence to use Your Data solely to provide and improve the Service.
We implement reasonable security measures to protect Your Data. However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect Your Data, we cannot guarantee its absolute security.
You may export Your Data at any time during your subscription. Upon termination of your account, we will retain Your Data for a reasonable period to allow you to export it. After this period, Your Data may be deleted.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or cancel your subscription through your account settings.
To the maximum extent permitted by applicable law, in no event shall EQUOS9, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
EQUOS9 does not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.
These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
